These Terms of Use (“Terms”) are a legally binding agreement between you and DARK SPACY for access to and use of the services available at darkspacy.com, including the Minecraft server, official website, store, and related features (the “Services”). By accessing or using the Services, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, you must stop using the Services.
DARK SPACY is an unofficial private Minecraft server, independently operated and not affiliated with, endorsed by, or sponsored by Mojang AB, Microsoft Corporation, or any of their affiliates. Minecraft is a trademark of Mojang AB. The Services offer custom game modes, extra features, and a store of digital items and benefits (VIPs, cosmetics, and more) priced in United States dollars (USD).
🔐 Microsoft authentication (SSO): Access is provided through Single Sign-On with your Microsoft account. DARK SPACY does not store or manage passwords. Authentication is handled by Microsoft under Microsoft’s own terms and privacy statement.
🎮 Valid Minecraft license required: You must hold a legitimate, active Minecraft license (Java Edition or Bedrock Edition, as applicable) purchased from Mojang AB or Microsoft. DARK SPACY does not sell or broker game licenses.
To use the Services, you must:
Why 13? The U.S. Children’s Online Privacy Protection Act (COPPA) restricts the collection of personal information from children under 13. Access also requires a Microsoft account. Under Microsoft’s age rules, the minimum age to create a Microsoft account in the United States is 13.
DARK SPACY does not knowingly collect personal information from children under 13. Users below that age cannot complete Microsoft sign-in and must not use the Services.
DARK SPACY uses Microsoft SSO. We do not create, store, or manage your Microsoft password. We receive only the identification needed to link your Microsoft account to the server, as described in the Privacy Policy.
You are responsible for the security of your Microsoft account and for all activity on the Services through that account. You agree to:
The following is prohibited and may result in suspension, a ban, or other action:
Items purchased in the store (VIPs, cosmetics, coins, and other benefits) are non-physical digital goods delivered only inside the server. Prices are in USD. You receive a limited, personal, revocable, non-transferable license to use those items in the Services. They have no real-world cash value and cannot be redeemed for money, except as required by law or as stated in the Refund Policy.
DARK SPACY may change, remove, or adjust benefits with reasonable notice. Purchases are processed by third-party payment providers such as Stripe. You authorize those providers to charge the payment method you select.
The website, branding, custom content, and materials we create are owned by DARK SPACY or its licensors. You may not copy, distribute, modify, or commercially exploit them without prior written permission. Minecraft and related marks belong to Mojang AB / Microsoft.
If you believe content on the Services infringes a U.S. copyright, send a notice that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) through our contact page. Include identification of the work, the allegedly infringing material, your contact information, a good-faith statement, and your signature. We may remove or disable access to the material and, where appropriate, terminate repeat infringers.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY U.S. LAW, DARK SPACY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that data will never be lost.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DARK SPACY AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO DARK SPACY IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50. Some jurisdictions do not allow certain limitations; in those cases the limitation applies only to the extent permitted.
You agree to defend, indemnify, and hold harmless DARK SPACY and its operators from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.
How we collect and use personal information is described in our Privacy Policy, which is incorporated into these Terms.
We may update these Terms from time to time. The revised Terms take effect when posted on this page, with the “Last updated” date. If a change is material, we will provide additional notice on the website when reasonably practicable. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Services.
We may suspend or terminate your access at any time, including for a violation of these Terms. If you are banned for breaking the rules, amounts paid are not refundable except as required by law or as stated in the Refund Policy. You may stop using the Services at any time.
Before filing a formal claim, you agree to contact us through the contact page and try to resolve the dispute informally for 30 days.
Except for claims that may be brought in small-claims court or claims for injunctive relief to protect intellectual property, any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in the United States, and the language will be English. YOU AND DARK SPACY WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
You may opt out of arbitration within 30 days of first accepting these Terms by sending a written notice through the contact page that includes your name, Microsoft account email, and a clear statement that you opt out of arbitration. If a court finds the class waiver unenforceable as to a particular claim, that claim must proceed in court and not in arbitration.
These Terms are governed by the laws of the United States of America and the State of Delaware, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration clause. If a dispute is not subject to arbitration, the state and federal courts of the United States will have exclusive jurisdiction, except where applicable consumer law requires otherwise.
Questions about these Terms can be sent through our contact page.
